You want to destroy the value of your Florida personal injury claim? Just forget about or hide prior problems to the injured area.

I recently met with a client who claims to have been injured in a car accident.  In my initial intake we always discuss the importance of telling me and telling their doctors about any prior problems or injuries in the same area of the body.  The answer to my question was “I have had no problems with my back.”  I ask, are you sure?  The answer, “I'm positive.”

The client sees a specialist and the specialist asks the client the same question.  The specialist writes in their record “patient denies prior problems.”  The specialist sends the client for some imaging studies (x-rays, CT scan, MRI), and when the report comes back, the radiologist notes that she compared the test to a test taken 18 months ago.

Now, my question and I'm sure the insurance adjuster's question is going to be, why was the test ordered 18 months ago, if you didn't have any problems? Was the client thinking that nobody would find out?

This type of situation happens all the time with people injured in accidents.  It plays right into the insurance company's hand and destroys the value of the client's Florida personal injury case. If you have been injured in an accident and your making a claim for your injuries, don't think that it helps you to deny prior problems to your lawyer or doctor, IT DOESN'T – all it does is play into the insurance adjuster's bias that all people who make personal injury claims exaggerate.
