You're injured in a Florida accident and you make an insurance claim because of your injuries.  You want the insurance company to treat you fairly and settle your claim quickly, will the insurance company do so? Insurance companies have a duty to protect their insured.  So if you were injured in a car accident that wasn't your fault, the at-fault driver's insurance company is required to protect their driver.

The number 1 thing that will motivate the insurance company to protect its insured is risk.  Insurance companies are in the business of assessing risk.  If the insurance company believes that there is a risk that its insured can be subject to an excess judgment, it will be motivated to resolve the case.  On the other hand, if the at-fault person has plenty of insurance to cover your injuries, the insurance company has no motivation to quickly or fairly settle your case.

One of the things that you have to remember if you're injured in an accident is that your injuries are personal to you – but settling your claim is just a business decision to the insurance company.  As harsh as it may sound, your claim is just a number to the insurance company.
